DISTANCE SALES AGREEMENT

This agreement has been prepared in accordance with the provisions of Law No. 6502 on Consumer Protection and the Distance Contracts Regulation.

ARTICLE 1 – PARTIES

BUYER:
Is a real or legal person who places an order via www.antalyadogalciftlik.com.

ARTICLE 2 – DEFINITIONS

In this agreement;

  • Law: Law No. 6502 on Consumer Protection
  • Regulation: Distance Contracts Regulation
  • Goods: Movable goods subject to sale
  • Service: Transactions made for a fee
  • Consumer: A person acting for non-commercial purposes
  • Durable Data Storage: Email, SMS and digital recording tools

ARTICLE 3 – SUBJECT

This agreement regulates the rights and obligations of the parties regarding the sale and delivery of products ordered by the BUYER from the SELLER's website.

ARTICLE 4 – FORMATION OF THE AGREEMENT

The BUYER;

  • confirms having read the pre-information text
  • confirms that the order incurs a payment obligation
  • confirms acceptance of this agreement

electronically.

ARTICLE 5 – PRE-INFORMATION

The BUYER accepts that they have been informed about the following matters before placing an order:

  • basic characteristics of the product
  • total price (including taxes)
  • shipping and additional costs
  • delivery time
  • right of withdrawal and conditions
  • seller contact information

ARTICLE 6 – PRODUCT AND PRICE INFORMATION

Product information is specified during the order.
All prices include VAT.

ARTICLE 7 – PAYMENT

Payment is made by;

  • credit card
  • debit card
  • wire transfer / EFT

Payment must be completed before the order is processed.

ARTICLE 8 – DELIVERY

  • Orders are delivered within a maximum of 30 days
  • Normally shipped within 1–3 business days
  • Delivery is made to the address specified by the BUYER

All responsibility lies with the SELLER until the product is delivered.

ARTICLE 9 – RIGHT OF WITHDRAWAL

The BUYER has the right of withdrawal within 14 days from the date of receiving the product.

ARTICLE 10 – EXCEPTIONS TO THE RIGHT OF WITHDRAWAL (FOOD SPECIAL)

Within the scope of Antalya Doğal Çiftlik products:

the right of withdrawal cannot be exercised for the following products:

  • perishable food products
  • fresh fruits and vegetables
  • products with expiry date risk

Also;

  • hygiene products with opened packaging
  • personalized products

are also outside the scope of the right of withdrawal.

ARTICLE 11 – EXERCISE OF THE RIGHT OF WITHDRAWAL

The right of withdrawal can be exercised;

  • by email
  • in writing

ARTICLE 12 – RETURN CONDITIONS

For returns:

  • the product must be unused
  • the packaging must be intact
  • it must be sent with the invoice

ARTICLE 13 – RETURN SHIPPING FEE

According to the legislation:

  • if a return carrier is specified → free of charge
  • if not specified → free of charge

✔ Therefore, return shipping is generally covered by the SELLER.

ARTICLE 14 – REFUND OF PRICE

The SELLER:

  • after notification of withdrawal
  • within a maximum of 14 days

will refund the entire payment.

ARTICLE 15 – DEFECTIVE PRODUCT

The BUYER has the right to:

  • return
  • exchange
  • free repair
  • price reduction

ARTICLE 16 – PERFORMANCE OF THE AGREEMENT

The SELLER is obliged to deliver the order within the specified period.

ARTICLE 17 – IF DELIVERY IS NOT POSSIBLE

If the product cannot be supplied:

  • the BUYER is informed
  • the payment is refunded

ARTICLE 18 – LIABILITY FOR DAMAGE

Any damages incurred until the product is delivered are the responsibility of the SELLER.

ARTICLE 20 – PERSONAL DATA

Personal data is processed within the scope of KVKK (Personal Data Protection Law).

ARTICLE 21 – DISPUTES

In disputes:

  • Consumer Arbitration Committees
  • Consumer Courts

have jurisdiction.

ARTICLE 22 – EFFECTIVE DATE

The BUYER is deemed to have accepted this agreement when placing an order.
